المنازعـات الانتخابية المحلية في ظل القانون العضوي 16/10

Abstract

للانتخابات أهمية بالغة لكونها هي المعيار المحدد إذا ماكان البلد ديمقراطيا أم لاويتضح هذا من خلال المبادئ و كذا الضمانات التي يقرها المشرع لقيام المشرع لقيام عملية انتخابية نزيهة و مشروعة ,و برغم من كل هذه الضوابط القانونية و كذا الهيئات الرقابية على صحة العملية الانتخابية المحلية إلى يشوبها في مراحلها جملة من الخروقات , و التجاوزات .. فبطبيعة الحال هذه الأخيرة خصها المشرع بإجراءات للطعن أمام الجهات المحددة قانونا لتحقيق نزاهة و شفافية العملية الانتخابية و تتجسد هذه الطعون في كل من طعون إدارية و طعون قضائية فلكل مرحلة من مراحلها جملة من المنازعات تقام وفق شروط و إجراءات محددة قانونا وهذا كله لضمان حق الناخب و كذا المترشح من أي تعدي و حماية من أي خرق يمس بشفافية العملية .

Abstract : The elections have a huge importance by being the selected standard wether the country is democratic or not this is evidenced by the principle and guarantees that the legistator. Apporves for a fair and le gitimate eléctrol process.but despite of all the legal controls and regula bodies on the vailidity of local electoral process, it suffers numerous violations. Naturally the legistator has singled out these violations by appeal procedures in front of the designated authorities. According to the legistator to ensure both integrity and transparency of the electoral process. These appeals are embodied in both administrative and judicial appeals, because every phase of these appeals has a set of of disputes held according to a specific terms and procedures, and all this is for two reasons : - protecting both the candidate and the voter from any infringement that would prejudice their rights - protecting the electoral process from any violation that would harm its transparency and validity .
