الكفاءة في الزواج

Abstract

الأصل في عقد الزواج أن ينبني على الاستقرار والدوام، وحتى يحافظ على مقصوده وضع الإسلام جملة من الضوابط والأسس التي يتحقق بها الانسجام والتوافق بين الزوجين عند عقد الزواج، وذلك بمراعاة التقارب بين الزوجين من الناحية الدينية والاجتماعية والثقافية، وهذا التقارب ما يسمى بالكفاءة في الزواج ، الذي يعد أحد أهم العناصر التي يعول عليها في تحقيق الاستقرار، وتجنب المفاسد، وفي هذا البحث دراسة لهذا العنصر لارتباط أثره بالثبات الأسري أو تزعزعه وجودا وعدما، من خلال البحث في موقف الفقهاء من اعتباره لتمام عقد الزواج وترتيب أثره ، ومنه معرفة الأحكام المتعلقة به، والصفات المعتبرة في الكفاءة وعلاقتها بالعرف، وربطها بالواقع والتطبيق العملي . Abstract: Stability and sustainability are the base that built on the marriage, and in order to ensureit purpose, Islam has established a set of rules and regulations to achieve cohesion and harmony between the spouses at the time of marriage, taking into consideration the rapprochement between the spouses in term of religion, social and cultural. This rapprochement or what is known as a competency in marriage, is considered as one of the most reliable elements in achieving stabilityand avoid troubles. In this research there is a focus on this element because of its majorimpact on family’s stability, by conducting a research onlaw theorists attitudes about multiple steps starting from being a requirement of marriage act fulfilment,consequences andextract regulations the characteristicsof marriage competency and it relation with custom, and linking them to reality and practical execution.
