dc.description.abstractAbstract: The Algerian legislator has ensured the status of referral to depository, making it one of the employee’s rights stipulated by law, and controlling it with formal and objective conditions, in order to preserve the public interest, and restricted it to cases that came exclusively to close the door of interpretation. Although the status of the referral to the custodianship has the consequences of losing the employee a lot of his rights temporarily due to his being referred to the custodianship, but this does not mean the termination of the job relationship is final, but the employee remains legally linked to his original administration. Also, the rights acquired by the employee before being referred to custodial remain preserved, and are reintegrated by force of law upon the expiry of the legal period specified for referral to custodial, even if it is in excess of the number.en_US
