Abstract

The issue of illegal immigration is of great importance due to the wide spreading of this phenomenon which has huge effect on people's stability, especially those of host countries, Moreover the issue of illegal immigration concerns the loss of human potential, which, if it was given thenecessary care in the countries of origin, would have an immense impact on the field of national development in many domains. Thus, we find that the international community has unanimously agreed to criminalize the phenomenon of illegal immigration and condemn the smuggling of migrants, and that addressing this phenomenon does not stop at the policy of criminalization and punishment only, but goes beyond it by finding security and judicial mechanisms to prevent.
