Abstract

The marriage contract is one of the most important contracts that require the principle of consent , and most importantly ,such a contract does not there is without the corner of consent ,which the Algeria legislator considers in the family law text as the foundation of the family and the basis of marriage ,and this is evident by establishing the principle of equality between spouses as one of the most important pillars of marriage contract by expanding the freedom of women to choose their husband and consent to the marriage contract ,and the legislator worked on this the issue is affected by the international agreement emerging in this field ,and at the same time trying to preserve the cultural heritage of Algerian ,but despite the legislator’s interest in regulating the corner of consent in the marriage contract, there were gaps that were not remedied, especially with regard to the rights granted to women , which were addressed international convention.
