Abstract

Given the impact of maintenance on family life, especially one the relationship of the spouses and the stability of their lives, and the widespread phenomenon of non-payment of maintenance, especially marital expenses, the Algerian legislature has guaranteed legal protection to this right by developing means and methods for its protection. The legislator also authorized the owner of this right, the wife, to seek judicial recourse, in return, the legislator also did not leave the party to perform the maintenance, the husband without protection, as the judge, in his judgment of the expense, had to rely on a set of criteria for her assessment. Even if it falls, the husband is allowed to go to court to demand the fall of the illegal expense of the young wife.
