Abstract

The Algerian legislator paid great attention to public endowment properties due to its religious devotional nature and its primary role in achieving social solidarity, through its intervention with the legal rules that guarantee the necessary legal protection for this type of endowment. Among this is the Algerian legislator’s interest in regulating the means of establishing a public endowment, given the linkage of establishing endowment properties to a fundamental issue, which is the existence of the endowment and ensuring the achievement of its purposes and its continuity, The central system for the management of the endowment tended to develop a series of legal texts for evidence in the issues of the endowment king. It was presented that the Algerian legal legislator did not limit it to specific means. It made the margin of evidence wide so that it accommodates all means of proof available legally and legally without exception. Means, since the words: "...by all legal and legal methods of proof...", which confirms that the establishment of the endowment property is available by any means of proof established in Islamic Sharia and in the Algerian positive legislation. In the Algerian legal legislation, this is to provide proof by legal methods.
