حظر إستخدام القوة في العلاقات الدولية

Abstract

بعد أن كان إستعمال القوة هو الوسيلة الأمثل لحل النزاعات بطريقة غير سلمية في القانون الدولي التقليدي ، إلا أنه ومع ظهور فكرة الدولة الحديثة مع مؤتمر وستفاليا ، بدأت الدول بعقد مجموعة من الإتفاقيات تمنع إستخدام القوة بين أطرافها ، أما خلاف ذلك فقد إعتبرته إستخدام مشروع لغاية إنشاء عصبة الأمم التي حاولت تعميم هذا المبدأ وجعله عالميا مع ذكر بعض الإستثناءات حصرا و النص على الإجراءات المتخذة بخصوصها ،غير أنه بعد الحرب العالمية الثانية ، ومع ظهور فكرة التنظيم الدولي الجديد ممثلا في الأمم المتحدة و حرصا منها على عدم تكرار ما وقعت فيه عصبة الأمم حرمت كل إستخدام للقوة في العلاقات الدولية و لم تكتف بالتحريم إستخدام القوة بل ذهبت إلى تحريم التهديد بإستخدامها أيضا ، ليصبح بذلك مبدأ حظر إستخدام القوة في العلاقات الدولية إلتزاما دوليا يمنع على الدول مخالفته إلا في بعض الحالات المحددة مسبقا لتماشي مع الواقع الدولي ، كما فوضت إختصاص اللجوء للقوة فيها لمجلس الأمن بشكل أساسي ، أو للمنظمات الإقليمية و الدول بعد الحصول على موافقة مجلس الأمن ، وأقامت نظام قانوني لتعزيز وحماية تطبيق هذا المبدأ بشكل فعال.
