Abstract: The principle of freedom of investment in Algerian legislation is of the most importance because it is one of the most important criteria for the size of the flow of investments and the ratio of attracting capital, as evidenced by the principles and the guarantees prescribed by the legislator in order to activate it, in addition to the expansion witnessed by the economic and commercial sector on The fields in which investment activity can be carried out freely, and this is why it is necessary to ensure that the legislator is aware of the status of guaranteeing freedom of investment, which is embodied in the provisions governing investment and thus constitutionally strengthened. However, for any exception, this applies to the principle of freedom of investment. Although the legislator has explicitly recognized the constitutional value of this principle, it has entailed a set of controls to regulate the investment process on the one hand and imposed limitations on the other to protect the system This is based on: "Freedom of investment and trade is recognized and practiced within the framework of the law"
