Abstract: “Alimony” is considered an renewed topic. The Algerian legislator addressed its rules in general in the Algerian family law in reliance with the Islamic Shariah. He pointed out that alimony is obligatory upon the husband as soon as he sleeps with his wife and that its main elements include supplying food, clothes, and medical care. Furthermore, he touched upon the most important effects that lead to the husband’s abstention from providing marital support, which include divorce, in addition to the penalty given to the husband if he refuses to pay the alimony, which is found under the Penal Code. Due to the importance of marital support and the need to preserve the wife’s financial rights, the Algerian legislator has established the alimony fund in case the husband refuses or delays payment. Therefore, in light of nowadays high cost of living, the wife remains under financial security especially if she has children.
