Abstract: Abstract: The principle right of syndication which is the basis of union legislation, and it was recognized for worker, employers and employers alike and it was explicitly enshrined in 1948، when the International Labor Conference adopted convention No.87 on right of syndication and the protection of the right to organize, this study deals with principle of right of syndication in the public service، which has been emphasized and protected by convention No.151 concerning Labor Relation in the public service as has been stipulated in several other international agreements and recommendations . As for the internal (national) level ، the Algerian legislator tried to embody the principle of right of syndication in the public service in accordance with international Standards by enshrining it constitutionally and legally in law 14-90 on law to exercise the right to syndication in addition to other relevant laws. however ، the practical reality has proven that bureaucratic practices reduce the size of guarantees that protect right of syndication in the public service, due to the absence of separation between powers the subordination of the judicial authority to the executive authority, in addition to some legal restrictions that respond to the essence of right of syndication and constitute a violation of the principle .
