Abstract: Competition is necessary and obligatory for the course of economic activity, but it may turn and become a burden on trade and on the merchant when illegal means are used in violation of the law and the ethics and norms of the profession, and this is what is called unfair competition. Therefore, the Algerian legislator, through Ordinance 03/03 amended and supplemented and related to competition, as well as Law No. 02/04, amended and supplemented, which defines the rules applicable to commercial practices, established that traders have the right to resort to the judiciary to protect their commercial activity, which is known as the claim of unfair competition. Which is a means resorted to by the plaintiff in which he requests compensation for the damage he sustained as a result of the acts of unfair competition and the cessation of the unlawful act. ).
