Abstract: The withdrawal of the state from the economic field was embodied by the legislator through the competition law and the development of rules and means to ensure free competition is the Competition Council, an administrative body representing an independent control authority for competition enshrined in article 23 of Law 08-12, which is complementary to order 03-03 relating to competition. Marketing is the fertile field of business practices and competition and therefore the association of the Competition Council with marketing is a legal and functional relationship manifested in its role as a marketing control mechanism and is derived from the Algerian competition law, which granted this council administrative terms of reference including broad advisory powers And other organizations in addition to its conflicting terms of reference are field powers representing remote control of dangers and investigations, repressive powers to issue preventive decisions, and decisions related to financial and other sanctions The Competition Board is an official expert in market control to ensure free and fair competition and protect economic public order.
