Abstract

The Algerian legislator stipulated the dispute over the marital home possessions upon divorce in Article (73) of the Algerian Family Code 02/05 and made it a comprehensive article for this dispute; Where the legislator made it clear that this dispute ends with evidence, so the saying of the wife or her heirs is usually for women, or the saying of the husband or his heirs is usually for men, taking an oath; So that each of the spouses claims ownership of the possessions in the house, or that one party claims ownership of some things, and the other party denies ownership of them or denies the existence of those things.
