Abstract: The development of international relations and scientific progress that covered all fields has cast a shadow over international responsibility, which necessitated concerted efforts towards developing new legal rules in order to create a legal system for international responsibility for the peaceful and military use of nuclear energy. According to the traditional theory, it was stipulated to arrange the responsibility of the state to commit a mistake that contravenes the provisions of international law or its international obligations. In view of the damages that may result from the use of nuclear energy, its special nature and its long-term impact, international law jurists have called for the need to develop international liability rules to suit the nature of those damages. Therefore, the peaceful and military use of nuclear energy deserves to be highlighted and supported, given that the harms of the peaceful use of nuclear energy can lead to grave consequences for humans and the environment.
