المساواة بين الرجل والمرأة في الوثائق الدولية والتشريع الجزائري

Abstract

لقد أولت الجزائر منذ الاستقلال اهتماما كبيرا بحقوق الإنسان وكرست في منظومتها القانونية مبدأ المساواة بين الرجل والمرأة في التمتع وممارسة الحقوق المدنية والسياسية والاقتصادية والاجتماعية والثقافية. والتزمت بالمبادئ والحقوق المعترف بها للفرد عامة والمرأة خاصة. وإن أهم الاتفاقيات التي صدرت بشأن المرأة ومساواتها مع الرجل، اتفاقية القضاء على جميع أشكال التمييز ضد المرأة "CEDAW"، وتعتبر هذه الاتفاقية بمثابة المتن الذي كتبت على هامشه جميع أعمال الأمم المتحدة من مؤتمرات في مجال المرأة. وعلى هذا الأساس فإن مبدأ المساواة بين الرجل والمرأة يعتبر أساسا لقيام الحقوق والحريات العامة كافة، مما يستدعي ضرورة حمايته وذلك بأن توضع الضمانات الكفيلة بالدفاع عنه، وحمايته من أي انتهاك قد يقع من السلطة. Summary : Since independence, Algeria paid a great attention to human rights. In its legal system, it paid more attention on the principle of equality between men and women in different fields such as politics, economic, social and culture. Also, Algeria had committed with the principles and rights which was recognized by the individual in general, and women in particular. The most important conventions which were dedicated to women and its equality with men are the “CEDAW”. This latter is considered as the body of a paragraph which has been written in it all the United Nations conferences concerning women. Consequently, the equality between men and women is fundamental for the establishment of public rights. Moreover, it requires the need to protect anddefend it. Also, protect it from any violation that may occur from the Authority.
