التفويض في القانون الإداري

Abstract

يعد التفويض الإداري وسيلة قانونية مهمة في التنظيم الإداري الذي تعتمده الدولة الحديثة في تسيير شؤونها العامة، فهو وسيلة لتخفيف العبء على الرئيس الإداري من خلال منح بعض من صلاحياته إلى مرؤوسيه، غير أن هذه الوسيلة القانونية لا يمارسها الرئيس بصفة مطلقة إذ تحكمها قيود وضوابط ينتج عن عدم احترامها جعل كل من تصرفات الرئيس والمرؤوس باطلة وغير مشروعة. وهدفت هذه الدراسة إلى تسليط الضوء على آلية التفويض الإداري في الهيئات المركزية والهيئات اللامركزية، كما تطرقنا إلى تبيين الشروط القانونية للتفويض الإداري من شروط موضوعية وأخرى شكلية بالإضافة إلى الآثار المترتبة عن التفويض بالنسبة لكل من المفوض (الأصيل) والمفوض إليه، ونهاية التفويض الإداري وإبراز مزاياه والمعوقات والصعوبات التي يمكن أن تعيق عملية التفويض والحلول المقترحة لتجاوز هذه الصعوبات. الملخص باللغة الإنجليزية Administrative delegation is an important legal instrument in the administrative management of the modern State, which is a means of easing the burden on the administrative head by granting some of his powers to his subordinates, but this legal instrument is not exercised strictly by the President, as it is governed by restrictions and controls that result from their failure to respect both the President's and the subordinate's actions are void and illegitimate. The study aimed to highlight the mechanism of administrative delegation in central and decentralized bodies, and to clarify the legal requirements for administrative delegation from objective and formal requirements, as well as the implications of delegation for both the Commissioner (principal) and the Commissioner, the end of administrative delegation, and the advantages and constraints that could impede the process of delegation and the proposed solutions to overcome these difficulties.
