الوصاية الإدارية على المجالس المحلية في ظل القوانين الإصلاحية

Abstract

إن النهوض بالتنمية المحلية الشاملة لا يمكن أن يتجسد إلا في ظل استقلالية إدارية حقيقية للمجالس المحلية المنتخبة، والتي تعد من أهم الركائز التي تقوم عليها اللامركزية، إلا أن واقع الحال يشير إلى أن الإستقلالية الممنوحة للمجالس المحلية نسبية، نظرا لخضوع الجماعات المحلية لرقابة السلطة المركزية وهذا بمناسبة أدائها مهامها، حيث نجد أن المشرع الجزائري لا يزال إلى يومنا هذا يكرس نظام الوصاية الإدارية المشددة، و الذي يعد محل دراستنا هذه و ذلك من خلال التطرق إلى آليات الرقابة الوصائية التي تمارس على أعضاء المجالس المحلية وعلى أعمالهم القانونية.

Abstract

The promotion of global local development can only be materialized in light of real administrative autonomy granted to local elected assemblies, which is one of the most important bases of the decentralization, but today; on the ground the local assemblies autonomy is so relative due to their submission to the central authority supervision on the occasion of exercising their functions, where we find that to until today the Algerian legislator is still devoted to strict administrative control system, which is the purpose of our study where it is exercised on the local assemblies members and their legal acts.
