Abstract

شركة التضامن هي شركة من شركات الأشخاص تتميز بأنها تقوم على الاعتبار الشخصي والثقة المتبادلة بين الشركاء، وفي الأغلب تتألف بين أفراد يعرف بعضهم بعضا ويثق كل منهم بالآخر، حيث تناولنا في هذه المذكرة تأسيس شركة التضامن و ادارتها ،وهي في العادة تجمعهم صلة القرابة أو الصداقة، حيث تعتبر شركة التضامن النموذج الأمثل في تطوير المشاريع الصغيرة، بالإضافة إلى مسؤولية الشركاء التضامنية غير المحدودة عن ديون الشركة يمكنها من الحصول على ثقة كبيرة بين الأوساط التجارية، إذ تناول المشرع الجزائري موضوع شركة التضامن من خلال المواد 551 إلى 563 من القانون التجاري الجزائري حيث قام بتنظيمها وحدد قواعد تسييرها، ذلك لما لها من مساهمات كأساس من أسس الاقتصاد الوطني.

Abstract The solidarity company is a company of individuals that is characterized by personal consideration and mutual trust between the partners. Which we mentioned the construction and the management of solidarity company. It is mostly composed of individuals who know and trust each other. They are usually associated with kinship or friendship. Where the solidarity company is considered as the ideal way for the small projects, as well as the responsibility of the unlimited solidarity partners for the company's debts, which enables it to obtain great confidence among the business circles. The Algerian legislator dealt with the subject of the solidarity company through Articles 551 to 563 of the Algerian Trade Law, where he organized and defined its rules of operation, which is related to the contributions as a basis of the foundations of the national economy.
