الحماية القضائية للعلامة التجارية في التشريع الجزائري

Abstract

تسمى العلامات المستخدمة لتمييز المنتجات و الخدمات بالعلامات التجارية ، اذ أنها تعتبر التزاما قانونيا في مواجهة كل منتج للسلع أو مقدم للخدمات ، و هو الالتزام الذي يقابل بمنح مالك العلامة التجارية حقوقا استئثارية عليها . و طالما أن العلامة التجارية يمكن أن تكون محلا للاعتداء عليها من طرف الغير فقد تدخل المشرع الجزائري لحمايتها منذ الاستقلال و ذلك بسن قوانين تنظمها و تؤطرها و تحميها ، وآخر قانون تم اعتماده هو الأمر رقم 03-06 المتعلق بالعلامات . و الأصل أن حماية الحقوق اختصاص أصيل للقضاء لأنه هو الجهة المختصة بتطبيق القانون بما يؤدي الى استقرار الحياة الاجتماعية بجميع نواحيها . و من ثم فموضوع الحماية القضائية للعلامة التجارية في التشريع الجزائري يجيبنا عن الحماية التي يكفلها مرفق القضاء للعلامة التجارية وفقا للقانون الساري المفعول ، بالإضافة الى تقييم فعالية النصوص القانونية المعتمدة في توفير حماية أشمل و أنجع .

Summary Marks used to distinguish products and services are called trademarks, They are a legal obligation for each product or service provider, This obligation grants the trademark owner exclusive rights . As long as the trademark can be attacked by third parties, the Algerian legislator has intervened to protect it since independence by enacting laws that regulate, frame and protect it. The last law adopted is Order No. 03-06 related to marks. The right to protection of rights is an inherent right of the judiciary because it is the competent authority to enforce the law in a manner that leads to the stability of social life in all its aspects . Thus, the subject of judicial protection of the trademark in Algerian legislation provides us with the protection given by the judiciary in accordance with the law in force, as well as evaluating the effectiveness of the legal texts adopted in providing more comprehensive and efficient protection .
