Abstract

The research aims at addressing most of the problems of the estate, in terms of its components, its inventory, and its division. This research dealt with the general concept of the estate in terms of its fate and the way it was divided among other nations, both ancient and modern, And to give a comprehensive definition of the estate. After this, the first chapter of this paper examines the components of the joint estate between Sharia and law and the elements of modern estate resulting from the insurance contracts, as well as this chapter, to give the most important issues related to the rights related to the estate. The second chapter, contains two parts, the first part was the introduction of most of the problems that impede the process of inventory of the estate, and the inventory of those entitled to this legacy, The second part has talked about the problems of delay in the transfer of the estate, as well as the problems that occur in the process of division, and each time or when studying the problematic, we try to give the most appropriate solution to these problems.
