Abstract: | The presumption of innocence is an essential element of fair criminal proceedings and must be fully observed during the investigation and trial, as stipulated in article 14: Of the International Covenant on Civil and Political Rights, "every accused of a crime has the right to be considered innocent until the offence is legally proven". The presumption of innocence is included in major global and regional human rights treaties as an aspect of fair trial. The importance of the trial is fair to the international criminal court's interest in achieving guarantees for the accused, starting with the presumption of innocence, in order to ensure his freedom and not to attack her during the investigation phase, then to examine the criminal act attributable to him and the responsibility of the accused, and his right to a lawyer to defend his rights in a legal context. Criminality is the effective role that eyewitnesses play in applying a fair sentence in exchange for their testimony, and in the end the court is concerned with redressing the damages left by the accused to the victim, legally in order to apply international law and justice. |
