Abstract: | The issue of marital alimony is an important topic, and the Algerian legislator has addressed it in the Family Law, in addition to his use of what Islamic Sharia brought to the jurists, and this is in accordance with Article 222 of the Algerian Family Code, as the marital alimony is obligatory for the husband in the case of the existence of the correct contract, but In some cases, the wife’s maintenance is waived, and her husband does not have to spend on her at that time, and she is obligated to spend on herself if she has money،Among the cases in which alimony falls is either because of the wife, which is five forms, such as the wife’s abstaining from her husband’s bed, or the wife leaving her husband’s house without his permission, or the wife volunteering without the husband’s permission, or the wife preventing herself from traveling or preventing herself in worship, and also the wife’s work without the husband’s permission As for the forfeitures of alimony without the choice of the wife, it is represented in the wife’s imprisonment, her young age, illness or kidnapping, and finally the insolvency of the husband, but in the case of the end of marital life, the alimony falls either with the death of one of the spouses or the ideal from an irrevocable divorce or in the event of a difference of religion and finally marital alimony falls Corruption of marriage because marital alimony is based on the correct contract |
